Property Management Regulation Act

Preamble: 

Whereas, the State of Nevada recognizes the importance of ensuring that rental properties are managed in accordance with state laws and regulations to protect the rights and safety of tenants; and

Whereas, the use of licensed property managers by landlords owning multiple rental units or residing a significant distance from their rental properties is essential to maintain professional standards and compliance;

Now, therefore, be it enacted to establish requirements for the use of licensed property managers in the management of rental properties in Nevada.

Section 1. Short Title 

This Act may be cited as the "Property Management Regulation Act."

Section 2. Purpose 

The purpose of this Act is to protect consumers by ensuring that landlords who own four or more rental units in the state of Nevada, or who live more than 60 miles away from their rental property, use licensed property managers to oversee their properties, thereby ensuring compliance with Nevada laws and regulations.

Section 3. Definitions For the purposes of this Act:

  • Landlord: An individual or entity that owns rental property in the state of Nevada.
  • Licensed Property Manager: A property manager who is currently licensed and permitted to operate in the state of Nevada according to state regulations.
  • Rental Unit: Any residential property available for rent or lease.

Section 4. Property Management Requirements 

(a) Landlords who own four or more rental units in the state of Nevada must use a licensed property manager to oversee the management of their properties. 

(b) Regardless of the number of units owned, landlords who live more than 60 miles away from their rental property must use a licensed property manager to oversee the management of their property.

Section 5. Registration of Rental Units 

(a) All rental units must be registered with the [designated entity], such as the Nevada Housing Division. 

(b) The registration must include the name of the owner, the current address, phone number, and the property manager's contact information.

Section 6. Enforcement and Penalties 

(a) The Nevada Housing Division shall be responsible for enforcing the provisions of this Act. 

(b) Any landlord found in violation of this Act shall be subject to penalties as determined by the Nevada Housing Division, including but not limited to fines.

Section 7. Effective Date This Act shall become effective on [specific date].
